This document outlines Cap-Off Firearms Training Academy Terms and Conditions:
1. Definitions
- “Services”: Firearms training, range time, educational materials, and online modules provided by Cap-Off Firearms Training Academy.
- “Premises”: Our business locations in Lassen County, California.
- “User”: Any individual accessing this website or participating in training services.
2. Legal Eligibility and Age Restrictions
By enrolling in our services, you represent and warrant that:
- You are at least 21 years of age.
- You are not prohibited by federal or California state law from possessing or handling firearms.
- You possess a valid government-issued identification, which you agree to present upon request.
- You are participating voluntarily and meet all legal requirements to handle firearms in the State of California.
3. Online Training and Certification Disclaimer
- 3.1 Theoretical Nature: Any online training modules provided by Cap-Off Firearms Training Academy are supplemental instruction, designed to meet California laws pursuant to instruction as part of the CCW certification process, and do not constitute a completed CCW certification program on their own.
- 3.2 Mandatory Live-Fire: Pursuant to California law, all applicants for a Concealed Carry Weapon (CCW) permit must complete an in-person, live-fire proficiency qualification with a California DOJ-certified instructor at an authorized range following completion of the online course.
- 3.3 No Authority to Carry: You acknowledge that an online course completion certificate does not grant you any legal right, permission, or authority to carry a concealed firearm.
- 3.4 Acknowledgement: By using this site and enrolling in an online program, you explicitly acknowledge that the responsibility for completing the mandatory in-person, live-fire portion of your training rests solely with you. Cap-Off Firearms Training Academy assumes no liability for legal consequences or permit denials resulting from your failure to complete the required in-person training.
4. Safety and Conduct Requirements
- Safety Protocols: All participants must follow all instructions from Range Safety Officers (RSOs) and instructors immediately.
- Zero Tolerance: We maintain a zero-tolerance policy for safety violations, suspected impairment (drugs/alcohol), or refusal to follow directives. We reserve the right to remove any person from our Premises or training sessions at any time. No refunds will be provided for such removals.
5. Payments, Refund, and Cancellation Policy
Because our classes require advance range reservations, strict student-to-instructor ratios, and limited seating, we have implemented the following Refund and Cancellation Policy.
5.1 Student Cancellations and Refunds (In-Person Training)
- Cancellations made 7 or more days prior to the course date: Students are eligible for a full refund of the course tuition, minus a 5% administrative processing fee.
- Cancellations made between 3 to 6 days prior to the course date: Students are not eligible for a refund, but the registration fee may be credited toward a future Cap-Off Training course.
- Cancellations made 48 hours or less prior to the course date: No refunds or course credits will be issued. (Exceptions for documented medical or family emergencies are evaluated on a case-by-case basis at our sole discretion).
5.2 Rescheduling Policy
If you need to reschedule your CCW class, you must notify us at least 72 hours before your scheduled class time.
- Students are permitted to reschedule one (1) time without penalty, provided the 72-hour notice is given.
- Subsequent rescheduling requests, or requests made inside the 72-hour window, will incur a $25 rescheduling fee.
- Course credits for rescheduled classes must be used within six (6) months of the original class date.
5.3 No-Shows and Late Arrivals
State laws require a specific number of instructional hours for California CCW certification. Therefore, punctuality is mandatory.
- Late Arrivals: Students arriving more than 15 minutes late to the classroom or range portion will not be permitted to join the class, as this disrupts the learning environment and violates state-mandated training time requirements. Late arrivals are treated as no-shows.
- No-Shows: Students who fail to attend their scheduled class without prior notification forfeit their entire registration fee. No refunds or rescheduling credits will be offered.
5.4 Safety Violations and Dismissal
Firearms safety is our absolute highest priority. Cap-Off Training instructors reserve the right to remove any student from the classroom or the firing range at any time if the student exhibits unsafe gun handling behavior, fails to follow the instructor’s directions, appears to be under the influence of alcohol or drugs, or displays an aggressive or disruptive attitude. Students dismissed for safety violations or disruptive behavior will NOT receive a refund or credit.
5.5 Failure to Qualify
Taking the CCW course does not guarantee certification. Students must successfully pass both the written examination and the live-fire shooting qualification as mandated by state and county regulations. No refunds will be issued to students who fail to meet the qualification standards. However, students who fail the shooting portion may be offered a discounted rate for a future private remediation session or re-qualification attempt, at the instructor’s discretion.
5.6 Legal Ineligibility
It is the sole responsibility of the student to ensure they are legally eligible to possess a firearm and obtain a CCW permit in California before registering. No refunds will be provided to students who are denied a CCW permit by their issuing agency due to background checks, past criminal history, or other legal disqualifications.
5.7 Cancellations by Cap-Off Training
While rare, Cap-Off Training reserves the right to cancel or reschedule a course due to extreme weather conditions, unexpected range closures, instructor emergencies, or low enrollment. In the event Cap-Off Training cancels a course, students will be notified as soon as possible and given the option of receiving a 100% full refund or receiving priority scheduling for the next available class. Cap-Off Training is not responsible for any secondary expenses incurred by the student (e.g., travel, lodging, or ammunition purchased separately).
5.8 Online Course Modules (LearnDash)
For the digital portion of the 16-hour initial and 8-hour renewal California CCW courses delivered via our online portal:
- Unaccessed Courses: If you purchase an online course but do not log in or access any of the lesson modules, you may request a refund within 7 days of purchase, subject to a $25 administrative fee.
- Accessed Courses: Because digital content is delivered immediately, once a student logs into the system and accesses any online lesson modules, quizzes, or course materials, the online training fee becomes strictly non-refundable.
- Technical Issues: If you experience technical difficulties or issues with your account access, please contact us immediately so we can resolve the issue. Technical difficulties do not automatically entitle you to a refund if the issue can be resolved by our support team.
6. Disclaimer: Inherent Risks
You acknowledge that firearms training and the use of shooting ranges involve inherent risks, including but not limited to bodily injury, permanent disability, death, and property damage. By participating, you expressly assume all such risks.
7. Liability Waiver and Release (California)
To the maximum extent permitted by California law, you hereby release, waive, and discharge Cap-Off Firearms Training Academy, its owners, instructors, and affiliates from all liability, claims, or demands for personal injury, property damage, or wrongful death arising from your participation in our services, whether caused by ordinary negligence or otherwise.
- Note: This release does not apply to injuries caused by our gross negligence, recklessness, or intentional misconduct.
- Requirement: A separate, signed physical Liability Waiver is required before participating in any live-fire training.
8. Privacy and Data
All personal information collected is handled in accordance with our Privacy Policy and applicable California law. We do not sell your personal data to third parties.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of the State of California. Any legal disputes or claims arising out of or related to these terms or our services shall be filed exclusively in the courts of Lassen County, California.
10. Modifications
We reserve the right to update these terms at any time. Continued use of our website or services constitutes your acceptance of any revised terms.
